Azad Kashmir Child Rape Case: Supreme Court Orders Arrest
Written By Waheeda Jammu Kashmiri
The Pakistan-administered Kashmir (Azad Kashmir) child rape case involving an 11-year-old girl has taken a significant legal turn, as the Supreme Court has ordered the arrest of the accused more than a year after the alleged incident.
Incident Reported in January 2025 in Islam Nagar
According to official records, the incident allegedly occurred on 13 January 2025 in Islam Nagar, Patan Sher Khan, a remote and underdeveloped village in Azad Kashmir. Police registered a First Information Report (FIR) on 15 January 2025, naming Ubaid Shoaib as the accused.
The case quickly drew attention due to the age of the victim and concerns over the initial handling of the investigation.
Delays in Police Action Raise Serious Concerns
Early stages of the Azad Kashmir child protection case were marked by delays in enforcement action. Local sources and a registered human rights organization reported that the accused remained at large even 10 days after the FIR was filed.
The organization further alleged that the suspect was seen moving freely and may have received backing from influential individuals. It also claimed that people raising awareness on social media faced intimidation and threats, including alleged death threats. These claims, however, have not been independently verified.
Vulnerable Family Situation Adds to Public Concern
The victim’s family background has intensified public concern. Reports indicate that the 11-year-old girl lives with her 10-year-old brother, while their father is suffering from mental illness.
Advocates argue that the already fragile family circumstances were worsened by delays in justice, increasing emotional and social pressure on the children involved.
Legal Proceedings and Bail Controversy
As the case progressed through the judicial system, the accused was reportedly granted bail at multiple stages. This development triggered criticism from observers and legal analysts, who questioned procedural delays in serious cases involving minors.
Experts emphasize that prolonged legal proceedings in child sexual assault cases can undermine public confidence in the justice system and prolong trauma for victims and families.
Supreme Court Intervention After 464 Days
After approximately 464 days, the Supreme Court intervened and ordered the arrest of the accused in the Azad Kashmir child rape case.
This decision marks a crucial turning point in the proceedings. While the trial remains ongoing, the court’s order has reportedly brought cautious relief to the victim’s family after months of uncertainty.
Renewed Calls for Justice Reform in Child Protection Cases
The case has sparked renewed demands for faster, more transparent judicial processes in cases involving child victims in Pakistan-administered Kashmir.
Human rights advocates stress the need for swift legal action, stronger victim protection mechanisms, and strict measures against intimidation or interference in sensitive criminal investigations.
As legal proceedings continue, the case stands as a stark reminder of the challenges faced in delivering timely justice in vulnerable and remote communities.
